Is a fire risk assessment a legal requirement?

Yes. Under the Regulatory Reform (Fire Safety) Order 2005 it is a legal requirement for all non-domestic premises and for the communal areas of residential buildings in England and Wales. Since the Fire Safety (England) Regulations 2022, further duties apply to blocks of flats.

Who is responsible for a fire risk assessment?

The 'responsible person' — usually the freeholder, managing agent, employer, landlord or building owner — is legally required to ensure a suitable and sufficient fire risk assessment is carried out, recorded and kept up to date.

Does the fire risk assessment have to be written down?

Yes. Since the Fire Safety (England) Regulations 2022 the assessment and the identity of the person who made it must be recorded in writing for all premises, regardless of size or number of employees.

All property types — blocks of flats, HMOs, offices, schools, retail units, pubs, hotels, restaurants, factories, warehouses, care settings, and temporary structures such as tents and marquees. Over 1,000 assessments completed.

What does a fire risk assessment include?

Escape routes and travel distances, fire doors and compartmentation, fire detection and alarm systems, emergency lighting, signage, firefighting equipment, electrical and ignition sources, storage and housekeeping, evacuation strategy, and management arrangements — each with a risk rating and recommended action.

What is PAS 79?

PAS 79 is the British Standards Institution's published methodology for fire risk assessment. It sets out a consistent, defensible structure for recording findings. All our reports are British Standards PAS 79 compliant.

What is the National Fire Risk Assessor Register?

Accepted Answer

The NFRAR is a register of fire risk assessors who have proven training, insurance, submitted case studies and audited annual CPD. Many assessors and companies are not on it. We are — which means our competence is independently verified rather than self-declared.

Why does it matter if my assessor isn't on a register?

Accepted Answer

If your assessor is not demonstrably competent, the assessment may not be considered 'suitable and sufficient'. As the responsible person you remain liable — enforcement action, insurance disputes and prosecution all follow the duty holder, not the assessor.

What are the penalties for not having a fire risk assessment?

Non-compliance can result in enforcement or prohibition notices, unlimited fines, and in serious cases imprisonment for up to two years. Insurers may also decline claims where no valid assessment exists.

Do I need a fire risk assessment for a block of flats?

Yes. The communal areas of any block of flats require a fire risk assessment. Individual flats behind their own front door are generally excluded, though the flat entrance doors themselves fall within scope.

What is a Type 1, 2, 3 or 4 fire risk assessment?

Type 1 is the standard non-destructive assessment of common parts. Type 2 adds destructive inspection of construction. Type 3 covers common parts plus a sample of flats non-destructively. Type 4 is the most thorough — common parts and flats, destructively. Most blocks need a Type 1.

Do HMOs need a fire risk assessment?

Yes. Houses in multiple occupation require a fire risk assessment covering shared areas, and licensing authorities commonly request it as part of the HMO licence application.

Do I need one for a small office or shop?

Yes. There is no size exemption. Any workplace or premises used by the public requires a written fire risk assessment, however small.

How long does the site visit take?

Typically 45 minutes to 3 hours depending on the size and complexity of the building. Larger portfolios and high-rise blocks take longer.

Do I need to be present during the assessment?

Not necessarily, but we need access to all communal areas, risers, plant rooms and roof spaces. A key holder or concierge is usually enough.

Yes. Every report contains a prioritised, plain-English action plan with realistic timescales, and we are available afterwards to explain findings to leaseholders, insurers or enforcement officers at no extra charge.

Yes. Under the Fire Safety (England) Regulations 2022, buildings over 11 metres require quarterly communal fire door checks and annual flat entrance door checks. We can carry these out alongside your assessment.
